HB 300: The HB 300 is an amendment to the existing federal and Texas laws that increases the protection of electronic protected health information (PHI) beyond the protections found in HIPAA. HB 300 prohibits the sale of PHI and requires notice to patients regarding the electronic disclosure of PHI. It also prohibits one from disclosing a patient’s PHI to any other person in exchange for direct or indirect payment. The new law also allows for civil penalties against a covered entity that wrongfully discloses a patient’s PHI in addition to any penalties for violating federal laws.
